"No Speed Limit" No More?

Destiny promised all of its subscribers a connection with limitless speed, or what the technical support people call as "open bandwidth". But for the past weeks, this isn't the case. Either our speeds are just a few bits faster from dial up or even slower than dial-up.
Users from TipidPC.com recently noticed that our bandwidth has been capped to 500kbps. (Editor's Note: You can see results here and here.)
Judging from the results on TipidPC, one could conclude that our bandwidths have been capped by Destiny. Most of the people posting there are new cable internet subscribers like me. I have been duped into signing because of the marketing slogan "No Speed Limit".
Now the question, do we cable internet subscribers have the right to sue MyDestiny for deception? Isn't this a breach of contract? We were promised unlimited bandwidth and now are speeds are capped without any official statements or announcements.
